Indefinite Leave to Remain
If you have successfully navigated the process of receiving asylum in the United Kingdom, you’re going to need to then successfully navigate the process of receiving indefinite leave to remain within United Kingdom borders.
Refugee status is paramount before you can begin this process with the United Kingdom Home Office – and is a prerequisite to receiving indefinite leave to remain within the United Kingdom. There are all kinds of forms that need to be filled out, all kinds of key criteria that need to be met, and very specific steps and procedures that you’ll need to successfully navigate with the help of an immigration solicitor.
At the same time, the process has been dramatically simplified and streamlined in the last few years, and you’ll find the United Kingdom Home Office website to be tremendously helpful throughout this journey.
The important thing for you to understand right away is that the recognition of you or your family as a refugee (or the approval of humanitarian refugee status) is only going to allow you to remain in the United Kingdom for five years – at least initially. If you’d like to stay in the United Kingdom for longer periods of time, you’re going to need to apply for extensions – or apply for the indefinite leave to remain within the United Kingdom.
This application needs to be submitted in full during the month before your limited leave expires, which means that you need to fill out the application and submit it to the Home Office no later than four years and 11 months to the day after you have been initially granted asylum or permission to enter because of humanitarian needs.
If you miss the deadline, you’re going to want to hire an immigration solicitor to handle your case, as the entire situation will be under a deep review – and you may be forced to leave the United Kingdom.
